Covid-19: BCI passes resolution allowing physical appearance of Advocates to facilitate release of people granted bail by Courts [Read Resolution]

 


On Wednesday, Bar Council of India passed resolution to allow Advocates to appear and facilitate the release of persons who have been granted bail by the Law Courts.

The Council has taken the decision as it came to its notice that State Bar Councils and some Bar Associations have restrained the Lawyers enrolled with them from appearing before the Courts due to spread of second wave of Corona.

The Council observed:

"Due to such resolutions, several persons who have been granted bail by the Law Courts are languishing in jail. In absence of Lawyers and/or the clerks it is quite impossible to furnish the bail bonds/sureties. The matter adversely affects the fundamental rights and right to liberty of the persons."

It thus with its resolution, it requested and directed the State Bar Councils to allow the Advocates for the purposes of facilitating the furnishing of bail bonds/sureties in order to get the accused persons (who have been ordered to be released by any Court of Law) released.

It however made clear that though Advocates are at liberty to take steps accordingly but the norms of Social distancing, wearing double masks, face shields etc. should strictly be followed.
